By installing or using Beats ("the Software"), you agree to these Terms of Service. If you do not agree, do not install or use the Software.

1. Who we are

Beats is developed and published by Delexo ("we", "us", "our"). We created the Beats desktop application only. We do not operate, own, or control any music platform, streaming service, or third-party website from which you may choose to download content.

2. What Beats is

Beats is a local desktop music player for Windows. It plays audio files stored on your computer and, if you choose to use that feature, can help you save audio from URLs you paste using third-party command-line tools (such as yt-dlp and spotDL) that are downloaded separately on first use.

We provide software. We do not provide music, playlists, hosting, or any online content library.

3. Your responsibility for content

You are solely responsible for:

We are not responsible for any content you add to Beats, whether you copied it from your own files, a link you pasted, or any other source. We do not review, monitor, or approve your files or downloads.

4. No affiliation with third parties

Beats is not affiliated with, endorsed by, or sponsored by YouTube, Google, Spotify, TikTok, SoundCloud, Instagram, Apple, Microsoft, or any other company, artist, label, or platform.

Any trademarks, service marks, or brand names belong to their respective owners. References to third-party services in Beats or its documentation are for identification only.

5. Download feature disclaimer

If you use Beats to download audio from the web:

Beats integrates with open-source tools maintained by other projects. We do not control those tools and are not responsible for their behavior or updates.

You agree not to use Beats to:

7. Disclaimer of warranties

BEATS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or compatible with every site or file format.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELEXO AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF BEATS OR ANY CONTENT OBTAINED THROUGH IT.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO BEATS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (IF ANY). BEATS IS OFFERED FREE OF CHARGE.

9. Software license

The Beats application source code is licensed under the MIT License. A copy of the MIT License is included with the open-source repository. These Terms of Service govern your use of the compiled application and installer.

10. Changes

We may update these Terms from time to time. Continued use of Beats after an update constitutes acceptance of the revised Terms. The version bundled with your installer is available in your installation folder under Legal\.
